A federal court has said Apple has to let developers use payment options that take consumers out of the tech giant's App Store ecosystem, circumventing Apple's 30% commission on most app transactions.
In the ruling, filed in the U.S. District Court in Northern California, the court said Apple will not be allowed to prevent "developers from including in their apps and their metadata buttons, external links, or other calls to action that direct customers to purchasing mechanisms, in addition to In-App Purchasing."
כלומר בגדול ביה"ש אומר שלא ניתן להגביל את התשלום רק למערכת של אפל, ושאפל חייבת לפרסם למפיצות את הדרכים שהן יכולות לגבות תשלום בלי לעבור דרך אפל עצמה. וזה צריך להיות תוך 90 יום.
מכיוון שאפל כבר "הריחה" את הכיוון זה בכל מקרה מה שהיא מתכננת לעשות (למשל כלפי ספוטיפיי).
השאלה לגבי העירעור. מצד אחד אפיק כביכול "הצליחה" לגרום לאפל "לפתוח" את התשלום לצורות אחרות. אבל (!) אנחנו עוד לא יודעים איך בדיוק - ובעיקר כמה פשוט זה יהיה. וגם אפיק עצמה כן נמצאה כי היא הפרה את ההסכם וחייבת לשלם את הרווח של 30% - כלומר עוד 3.6M$.
מצד שני אפל נמצאה אשמה ב-9 מתוך 10 הסעיפים - כאשר הסעיף ה-10 שהיא לא נמצאה אשמה הוא היחסית מרכזי - היא לא הפרה את ההגבלים העסקיים עפ"י השופט. זה שהיא מצליחה מאוד ונחשב שוק גדול ויחסית מנופוליסטי לא אומר שהיא לא יכולה לגבות 30%.
Judge Rogers ruled that Epic had failed to show that Apple violated federal or state anti-trust laws, but ruled that Apple did violate California's competition laws through the anti-competitive behavior of disallowing any mention of other payment systems within apps. Rogers did believe that the 30% revenue cut that Apple charges may be "unjustified" relative to the value they offer, but without significant competition to compare alternate schemes, she could not make any direct order on this.
